Official Terms and Conditions
These Terms and Conditions govern the Tech SummerFest Microsoft Visual Studio Team System
2008 Team Suite giveaway.
ELIGIBILITY:
- The Tech SummerFest
Microsoft Visual Studio Team System 2008 Team Suite giveaway is open only to
registered attendees of the Tech SummerFest Technology Showcase.
- Employees of
Microsoft, the Promoter, the Organisers or their affiliates, subsidiaries,
advertising or promotional agencies are not eligible to enter the Tech
SummerFest Microsoft Visual Studio Team System 2008 Team Suite giveaway nor
are members of these employees' families (defined as parents, children,
siblings, spouse and life partners).
TO ENTER:
- Tech SummerFest
Technology Showcase attendees will receive a ticket in the prize during
registration on the morning of the Tech SummerFest Technology Showcase.
- To enter to prize
draw, you must be a registered attendee at the Tech SummerFest Technology
Showcase and you must attend the event in person to receive your entry.
- Tickets will only
be given out during the registration period which is 8:00am to 11:00am
(local time in each location) on the morning of the Tech SummerFest
Technology Showcase. Registered attendees arriving and registering after
11:00am may still attend the event but will not be receive a ticket in the
prize draw and will therefore not be eligible to win the prize.
- Only one entry per
registered Tech SummerFest Technology Showcase attendee is permitted.
- Entry constitutes
full and unconditional acceptance of these Terms and Conditions. The
organiser reserves the right to disqualify anyone in breach of these Terms
and Conditions.
SELECTION OF WINNERS:
- The winner of the
Tech SummerFest Microsoft Visual Studio Team System 2008 Team Suite giveaway
in each location shall be the first eligible entry drawn from a pool of all
eligible entries in that location.
- The draw for the
winner of the Tech SummerFest Microsoft Visual Studio Team System 2008 Team
Suite giveaway shall be made immediately following the afternoon tea break
during the Technology Showcase day in each location.
- The winner is not
required to be present at the draw to win the prize.
- The winner of the
Tech SummerFest Microsoft Visual Studio Team System 2008 Team Suite giveaway
shall be notified by email by the Promoter.
- Except where
prohibited by law, the winner agrees that the Promoter may use the name and
photograph of the winner for promotions, marketing and publicity, unless
otherwise advised. If you do not consent to your name and photograph being
used for these purposes the Prize will be considered to be forfeited and a
redraw will take place.
PRIZE:
- The prize for the
winning entry in the Tech SummerFest Microsoft Visual Studio Team System
2008 Team Suite giveaway is 1 x license of Microsoft Visual Studio Team
System 2008 Team Suite (the “Prize”).
- There is one Prize
for each of the three locations the Tech SummerFest is scheduled to run.
- The winner is
responsible for any applicable license terms and conditions required by
Microsoft Corporation in order to use the Prize.
- The prize is
provided to the Promoter by Microsoft Corporation for the purpose of using
as a prize at the Tech SummerFest events. The Promoter and Organisers are
not responsible or liable for the any damages or loss incurred by the winner
or associates of the winner through their use of the Prize.
- The Prize must be
taken as stated. The prize is not exchangeable or transferable and cannot be
redeemed for cash or other goods or services. If a winner is unable to use the Prize as stated it will be forfeited
and no compensation will be payable.
- The total prize
pool for this promotion is valued at approximately AU$60,000. This is
calculated as the Recommended Retail Price for the three copies of the
Prize.
- A winner may be
liable to declare the Prize for tax purposes. The Promoter takes no
responsibility for any tax payable on the Prize.
If any tax is payable on a prize it is the sole responsibility of the
winner.
- If the Prize is not
available for reasons beyond the control of the Promoter, the Promoter and
the Organisers may withdraw the Prize at any time including after the
drawing of the Winner.
OTHER:
- No correspondence
will be entered into regarding either the Tech SummerFest Microsoft Visual
Studio Team System 2008 Team Suite giveaway or these Terms and Conditions.
In the unlikely event of a dispute, the organiser’s decision shall be final.
- The Organiser
reserves the right to amend, modify, cancel or withdraw the Tech SummerFest
Microsoft Visual Studio Team System 2008 Team Suite giveaway at any time
without notice.
- To the extent
permitted by law, the Promoter and its associated agencies or companies are
not liable for any:
- Error, omission,
interruption, deletion, defect, delay in operation, theft or destruction or
unauthorised access to, or alteration of entries; or
- Loss or damage
whatsoever (including but not limited to direct or consequential loss) or
personal injury however caused including, but not limited to, by their or
any of their negligence, suffered by the Entrant, the Winner or any other
person relating to the use or enjoyment of, or non-delivery or
non-useability of, a prize.
- The Promoter
accepts no responsibility or liability for third party provider, or for any
events beyond its reasonable control, including, without limitation, natural
disasters, war, terrorist attacks and civil unrest. The Tech SummerFest
Microsoft Visual Studio Team System 2008 Team Suite giveaway and these Terms
and conditions are governed by applicable Australian and State laws.
PROMOTER:
- The promoter of the
Tech SummerFest Microsoft Visual Studio Team System 2008 Team Suite giveaway
is Portal Synergy Pty Ltd, GPO Box 111, Brisbane QLD 4001.
ORGANISERS:
- The organisers of
the Tech SummerFest are Portal Synergy Pty Ltd, Wardy IT Solutions Pty Ltd
and AB Training Pty Ltd. These entities are collectively referred to as the
Organisers of the Tech SummerFest Microsoft Visual Studio Team System 2008
Team Suite giveaway.
